1. What if I cannot afford to pay?

We have options available if you cannot pay your citation right away. You must inform us regarding what you are able to pay and we will work with you. We have payment plans available; you may have an extension if you need a little more time, and we offer community service to those that qualify.

2. Will I be arrested if I missed my court date passed?

No, you will not be arrested. Should you not respond, you will be sent a pre-warrant letter in the mail. At this point you may still inform the Court as to what you would prefer to do regarding your citation.

If you fail to respond to the pre-warrant, a warrant will be issued. Once you receive a warrant, a hold will be placed on your driver’s license and you will not be able to renew it. An additional hold will be placed on your vehicle registration; you will not be able to renew or register your vehicle. Additional court fees will apply.

3. What do I need to do if I want to take the Driver Safety Course?

Please read your plea form. See additional eligibility requirements.

• You must not have taken a Driver Safety Course within the past 12 months to get a citation dismissed.
• You must not have a Commerical Driver’s License.
• You must submit a copy of your valid Texas Driver’s License and Proof of Insurance.
• You must not have been going over 25mph of the posted speed.
• Send us a money order/cashiers check in amount of $144.00.

4. What are the hours of the Municipal Court?

We are open Mondays and Tuesdays from 9:00 A.M. to 5:00 P.M. If you can’t make it during these hours please submit your information in the drop-box. The court clerk will check the drop box on the next available business day.

5. Where are you located?

We are located off Highway 80 close to where it intersects with Highway 142. We are located on the same strip as the Martindale City Hall and Martindale Community Library.

6. What is deferred disposition?

Deferred Adjudication or Deferred Disposition is a type of probation. Defendant is placed on a probation for a certain period of time, typically 90 to 180 days. If the probation is successfully completed, the case is “dismissed”- without a conviction. If conditions are not met, the defendant will be convicted and have to pay the fine.

7. Do I have to appear in court?

No, you do not have to appear in court if you send in your plea form and inform the Court of your decision regarding your citation. For more information, call the Municipal Court at 512-357-6700.
